The investigation into the murder of a 44-year-old man in Dublin earlier this month is being examined by the Garda Síochána Ombudsmans Commission.
Patrick "Pappy" Lyons was shot five times as he was walking along Belclare Terrace in Ballymun on Thursday 11 February.
Lyons, who was the father of a 10-year-old boy, died at the scene.
He was not known to be involved in gang activity and gardaí do not believe his murder is gang or feud related.
In a statement GSOC said a referral had been received from a Garda Superintendent related to his murder.
The matter is now being examined.
Gardaí confirmed that the matter had been referred under section 102 of the Garda Síochána Act.
The Garda Press Office said that as the matters are being investigated they cannot make any further comment.
