An appeal by secondary teacher Enoch Burke against his suspension and dismissal from his position at Wilson's Hospital School in Westmeath, is due to take place on Friday, in Athlone.
However, in a statement today, Mr Burke has raised issues about the impartiality of two of the three people on the disciplinary appeal panel (DAP).
He claims they are not impartial on the issue of "transgenderism".
He has also said he has not yet received materials, including documentation and audio and video material requested by him.
He said he wrote to the disciplinary appeal panel on Friday expressing his concerns but has not yet received a reply.
Mr Burke also said he has asked the DAP to request materials from the school’s board of management, which he said are central to his case.
These include, minutes of board meetings held in May, June and August of last year as well as a recording of his contribution to a chapel service in June 2022 and screenshots of whatsapp messages between the then principal of the school and the chairperson of the board.
Mr Burke said this material has not yet been provided to him.
He said the refusal of the DAP to engage with his concerns is "regrettable, incomprehensible and unacceptable" and he said he was calling on the chairperson, Seán Ó Longáin, to address the issues "as a matter of urgency" before the hearing on Friday.
In his emails to the DAP, Mr Burke said he will be accompanied on Friday by his mother, Martina, his brother Isaac and sister, Ammi "for support".
