The High Court has ruled that teacher Enoch Burke must pay the legal costs for his failed defamation action against the publishers of the Sunday Independent.
Mr Justice Rory Mulcahy rejected arguments made by Mr Burke that the court should depart from the normal course where the losing side pays the costs of the action.
It followed a judgment issued last month by Judge Mulcahy who ruled that Mr Burke had not been defamed by an article published in the Sunday Independent in October 2022 which wrongly stated he had been annoying other prisoners by repeatedly expressing his religious beliefs.
A four-day hearing took place in May.
The judge said while the contents of the article were untrue, they did not injure his reputation.
In his ruling on costs, issued this week, the judge said Mr Burke had "not identified anything which would justify a departure from the default position that the defendants, having been entirely successful in their defence of the proceedings, were entitled to their costs".
