Cork City Council has been granted an injunction restraining a couple from erecting or re-erecting a marquee or unauthorised structure for their son's wedding reception near their home at Mahon in the city.
The injunction was granted at the Circuit Civil Court in Cork by Judge Seán Ó Donnabháin, after he was told that a marquee had been erected on Wednesday at a vacant bay at Meelagh group housing scheme in Mahon.
The injunction was granted against James and Julia Keenan who, the court was told, lived at 7 Meelagh. It was sought after they erected a marquee for their son's wedding reception tomorrow.
The structure was removed overnight following meetings with council staff.
The injunction was granted on an ex-parte basis, meaning James and Julia Keenan were not represented in court.
Barrister for Cork City Council, Meg Burke, told Judge Ó Donnabháin that the defendants' son is getting married in Shannon tomorrow.
She said council staff had engaged with Mr Keenan who told them the marquee was primarily for the groom's family and for the bride, with around 40 people expected.
She said current restrictions only permit gatherings of up to 15 people outdoors.
She said James Keenan initially refused to take down the marquee, saying he had spent a lot of money on his son's wedding reception.
Ms Burke also said the council was concerned that - while there was no suggestion James and Julia Keenan were involved - there was an ongoing feud involving extended family members at present.
Cork City Council was also given permission to remove the marquee if it is re-erected.
