It is understood the Minister for Justice Frances Fitzgerald will bring a memo to Cabinet tomorrow on the accessing of journalists' telephone records by the Garda Síochána Ombudsman Commission.

Minister Frances Fitzgerald recently announced a review of the legislation, the Communications (Retention of Data) Act 2011.

It was recently revealed that GSOC had viewed the telephone records of two journalists without their knowledge on foot of a complaint about reports on the death of the model Katy French.

It is understood that there are currently nine criminal investigations looking at whether gardaí allegedly leaked confidential information to journalists.  

Four of the investigations, it is believed, are being carried out by the gardaí and five by GSOC, which has the same powers as the gardaí in this area. 

Earlier, the GSOC press office said it had no comment to make on its current practice or policy on when and how it accesses the phone records of journalists.

The National Union of Journalists has called for support to amend the law which allows GSOC to access phone records.

The Irish Council for Civil Liberties and Garda representative bodies have also expressed concern.
