Deadline approaches for symphysiotomy survivors' redress scheme

The deadline for women affected by the practice of symphysiotomy to apply to the redress scheme for compensation expired earlier today.

The Department of Health said 366 women have now applied to the symphysiotomy payments scheme.

The scheme is supported by two of the three campaign groups.

Survivors of Symphysiotomy opposes the scheme. 

Marie O'Connor of SoS has said a large volume of medical records, which had not been available up to recently, have been secured. 

The deadline for applications was 5pm.

Awards can be made at three levels - €50,000, €100,000 or €150,000.

Applications are being assessed by former High Court judge, Maureen Harding Clarke.

The scheme has a fund of €34m.

In exceptional circumstances, Judge Clark has discretion to extend the time for receipt of applications by an additional 20 working days, which would be to Wednesday 14 January 2015.

The Survivors of Symphysiotomy group (SoS), which opposes the scheme, says the ex-gratia payments do not meet international human rights standards for redress, because there is no admission of wrongdoing.

It says the waiver on acceptance of a payment shields those involved in the practice.

The group also says the level of restitution is low and  that today's deadline to apply is too tight and fails to recognise there are thousands of Irish women in Britain who may be eligible but who may be unaware of the scheme.

Women can opt-out of the scheme at any stage in the process, up to the time of accepting their awards, if they want to pursue legal action.

Sheila O' Connor of Patient Focus said that a number of payments have been processed and are expected to be paid to women before Christmas.

She said the payment scheme was a good, non-adversarial system but she also had no issue with the deadline for applications being extended beyond today.
