The Dáil is going to be asked to approve funds to fight former Rehab boss Angela Kerins' legal challenge against the Public Accounts Committee.
It is likely that the motion will come before the Dáil shortly, possibly within the next week.
It is understood that legal advice from a senior counsel was presented at a private meeting of the Houses of Oireachtas Commission today.
This advice was requested by the Commission in order to find out more about the implications for the taxpayer of defending Ms Kerins' challenge.
Politically there is a view that the challenge cannot be ignored and must be contested in the courts.
If the motion is passed by the Dáil it will allow for legal proceedings to get under way "in a manner that safeguards" the taxpayer.
Last July the High Court granted Ms Kerins leave to bring judicial review proceedings against the PAC and others.
The Oireachtas has until Monday week next to indicate to the court if it intends contesting the challenge.
