HSE in case over HIV-positive mother-to-be

High Court - To consider evidence from health experts tomorrow

The Health Service Executive has requested a High Court order for anti retro-viral drugs to be administered to a child upon birth, because its mother has been tested positive for the HIV virus.

The High Court heard that the drugs would give the child the best
possible start in life.

The HSE suggested that the woman should undergo a Caesarean section on Monday.

However, the woman, who is heavily pregnant, has requested the birth be delayed in order to determine the pros and cons of the drugs.

Lawyers for the woman, who cannot be named for legal reasons, say there is evidence to show people have died from the drugs before.

Mr Justice George Birmingham has ordered an emergency hearing tomorrow to hear evidence from health experts.
