A loophole in the law which means gardaí cannot arrest motorists they know to be disqualified from driving will be dealt with by new legislation.

A spokesman for the Department of Transport said he is hopeful that the measures will be introduced later this year.

Earlier today it emerged that if a disqualified driver is stopped at a checkpoint, gardaí have no power to arrest the motorist or to seize the driver's licence.

Under existing legislation a driver who is disqualified from driving after receiving 12 penalty points must voluntarily surrender his or her licence.

The Department of Transport says that of the 98 drivers who have been disqualified under the system to date, 34 have handed over their licences and the remainder, 64, have failed to do so.
