BUPA Ireland today received leave in the High Court to issue judicial review proceedings challenging the decision of the Minister for Health to begin risk equalisation levy payments.

It also received leave to issue judicial review proceedings challenging the Health Insurance Authority's recommendation on which it was based. 

BUPA Ireland says the move is part of its campaign to stay in the health insurance market in Ireland and was signalled in High Court proceedings last month.

In these new proceedings, the company will contend that the decision-making processes of the Health Insurance Authority and the minister as well as the decision itself were legally flawed.
