Tom Gilmartin - Continues Mahon evidence

Developer Tom Gilmartin has told the Mahon Tribunal that he is 'amazed' to hear that Liam Lawlor got details of a confidential statement he gave to his solicitor.

The tribunal has heard that Mr Gilmartin made an informal statement to his then solicitor, Noel Smith, in 1998 at a time when he was not co-operating with the tribunal.

Mr Lawlor, who is applying for Mr Gilmartin's earlier statements to be released, claimed that Mr Smith had given him details of this conversation, which was recorded on tape.

Mr Gilmartin said he regarded this as a very serious allegation, but Chairman Alan Mahon said he would have to take it up with Mr Smith.

Judge Mahon said he will rule later on Mr Lawlor's submission.

Meanwhile, Liam Lawlor has accused Tom Gilmartin of being a blatant perjurer in his evidence to the tribunal.

Mr Lawlor claims he advised Mr Gilmartin at the time that his proposed shopping centre was five times the size specified in guidelines and was doomed to failure.

But Mr Gilmartin responded by saying that was a ‘damn lie’ and added that Mr Lawlor had been 100% in favour until he was refused money.

Mr Gilmartin said Mr Lawlor had ‘sold his wares’ to Owen O'Callaghan in 1988 at the same time he trying to extort money from him.
