Council gets go-ahead to appeal court order

Dún Laoghaire-Rathdown County Council has begun the legal process that could clear the way for work on the final section of the M50 motorway to resume.

Today the President of the High Court told lawyers for the council that they could bring their application before the court on Monday.

The council is seeking to have an existing court order lifted.

The order granted by the Supreme Court last February presented the council from partially destroying the ruins of Carrickmines Castle on the grounds that it could be a national monument.

However, a few months later the Minister for the Environment issued an order allowing for a motorway interchange to go through part of the site despite the National Monuments status.

His order could only take effect after both Houses of the Oireachtas had sat for 21 days. That time barrier has now been reached and the case will come back before the High Court on Monday.
