The Flood Tribunal has given the builder, Tom Brennan, another chance to comply with an order for discovery against him. Mr Justice Feargus Flood said that it appeared that some documents had been produced and that others were on the way. He said that it would therefore be inappropriate to invoke the powers of the High Court at this stage. However, he said that the orders must be fully complied with by Tuesday next.
The orders for discovery relate to trust companies in the Isle of Man and Liechtenstein. Counsel for the Tribunal, Pat Hanratty, said that Mr Brennan had not complied. Counsel for Mr Brennan, Martin Hayden, said, however, that every effort had been made to get the files. He said that an administrator of a trust company in the Isle of Man was refusing to hand over all records because it was a private trust. Other documents arrived from Liechtenstein this morning.
However, Pat Hanratty said that the Tribunal was being given excuses and was being stonewalled. He said that it was preposterous to suggest that his administrator could refuse the owner of a trust company documents. He said that it was only when threatened with the High Court that Mr Brennan made serious efforts.
