The Flood Tribunal has heard that the builders, Tom Brennan and Joe McGowan, did not know that the files of their former solicitor contained secretly-taped conversations when they agreed to release them to the Tribunal. Philip Russell, whose father George acted for Mr Brennan and Mr McGowan, told the Tribunal that he never revealed to the two men that he had made the tapes. He also confirmed that he had secretly photocopied a diary belonging to one of the men. Mr Russell was being cross-examined by counsel for Mr Brennan and McGowan.
