Tyrone's appeal to the Disputes Resolution Authority to have midfielder Conn Kilpatrick available for today’s Allianz Football League derby with Derry has been unsuccessful.

Tyrone and Kilpatrick are still entitled to a full hearing next week if they wish, but the player is suspended for today and misses the eagerly-awaited clash with the reigning Ulster champions.

Kilpatrick was issued a straight red card last Sunday for a high challenge on Roscommon's David Murray.

A one-match ban was proposed by Central Council for 'behaving in any way which is dangerous to an opponent'.

The proposal was upheld by the Central Hearings Committee. Kilpatrick’s personal hearing in front of the CHC was held on Thursday.

Kilpatrick then took a case to the Central Appeals Committee, which was rejected on Friday night.

RTÉ Sport has been told that Tyrone GAA then went to the Disputes Resolution Authority with the case, but their application for interim relief was refused.

They are still entitled to a full hearing next week if they wish, but the player is suspended for today.

The DRA considered in detail the application for interim relief, including the written submissions of all parties received over night, but found that the claimant had failed to meet the criteria necessary for the granting of interim relief.

As such, the application for interim relief was refused.

Tyrone meet Mickey Harte’s Derry in round 2 of the Allianz football league at Celtic Park today at 3.45pm.
