A district court judge has dismissed charges of assault, obstruction and breach of the peace against Kerry footballer Aidan O'Mahony.

Judge James O'Connor described the evidence against Mr O'Mahony as lacking cohesion and credibility, and he said he found it difficult to understand why the charges were brought against him.

The judge said any reasonable person could see the charges could not succeed.

Evidence in the case was heard yesterday and Judge O'Connor delivered his judgment this morning.

He said the evidence fell completely short of the required standard of proof and did not stand up to cross-examination. He said Mr O'Mahony, a student garda from Rathmore, did nothing legally or morally wrong and he had no criminal intent.

The charges were brought following two incidents outside Mustang Sally's nightclub at Main Street, Killarney, in the early hours of 2 January last year.

Judge O'Connor said the nightclub's security staff completely over-reacted.

Mr O'Mahony had pleaded not guilty to the charges. Afterwards his solicitor, Padraig O'Connell, said the judgment vindicated Mr O'Mahony's plea of innocence.

Mr O'Mahony was man-of-the-match in last year's All-Ireland football final against Mayo.
