Two men appear in Kerry court charged with possession of cannabis

Two men have appeared before Killarney District Court charged with possession of cannabis and possession of cannabis for sale or supply.

The allegations relate to two locations on 10 January, and the court heard the drugs had been sent for forensic analysis.

However, the value was "likely" to be such that the matter would not remain at district court level.

The estimated street value of the seizure on foot of an intelligence led operation by members of the Kerry Drugs Division is thought to be in the region of €165,000, the court was also told.

A Polish interpreter was sworn in at the beginning of the proceedings.

Piotr Sikorski of Coolbane, Ballyhar, Killarney, is charged with possession of cannabis and with possession of the drug for sale or supply at the N22 Tralee Road, Derreen, Killarney on 10 January contrary to Section 3 and Section 15 of the Misuse of Drugs Act.

The 44-year-old is also charged with possession of cannabis, and possession of it for sale or supply at Coolbane, Ballyhar, on 10 January.

Evidence of arrest, charge and caution in Killarney Garda Station was given by Garda Gerald O'Sullivan.

Court presenter Sergeant Stephen O’Brien said the State was not objecting to bail on the meeting of a number of conditions.

These include that the accused hand over his passport, and reside at Coolbane, Ballyhar.

Judge David Waters remanded Mr Sikorski on bail to appear in Killarney again on 20 January for instructions from the Director of Public Prosecutions.

Krystian Misiak, 32, with an address at Fleming’s Lane, Killarney, also appeared charged with the same four offences.

Mr Misiak is further charged with having in his possession "a flick knife which had a blade which was sharply pointed".

Garda Stephen Foley, giving evidence of arrest, charge and caution in Listowel Garda Station, said Mr Misiak had made no reply to the drugs charges.

In relation to the alleged knife offence charge, under the Offensive Weapons Act, he had replied: "Yes, this was my knife, a small knife."

Court presenter Sgt O’Brien said the State's application was for remand in custody.

Garda Foley said the 32-year-old is believed to be "heavily involved" in the sale and supply of drugs in Kerry, and there were no bail conditions that would alleviate gardaí's concerns that Mr Misiak would continue to sell and supply drugs if released on bail.

Defending, solicitor Padraig O'Connell, said his client is only facing an allegation "at this time" and there was no forensic analysis to prove what was seized is cannabis.

Judge Waters refused bail and said there were no bail conditions that would satisfy him that Mr Misiak would not commit further serious offences.
