Tathony House tenants 'thrilled' as RTB finds notices of termination invalid

Residents at Tathony House in Dublin 8 have been informed that notices of termination served on them in October last year were invalid.

Residents of all 34 apartments in the building had been issued with notices of termination as the landlord wanted to sell.

A number of residents took cases to the Residential Tenancies Board (RTB) and hearings took place last month.

An eviction date of 2 June expired before the RTB hearings concluded and at the time around ten households remained living in the Kilmainham apartment building.

Tathony House tenant and People Before Profit Councillor Madeleine Johansson told RTÉ News that tenants have now received RTB decisions determining that the notices were invalid.

"Tenants here are absolutely delighted and thrilled, it's like a weight has been lifted off our shoulders," Ms Johansson said.

The landlord can now appeal the decision to a tribunal.

RTÉ understands that he could also opt to sell the property with tenants in situ.

A spokesperson for the RTB said that while it does not comment on individual cases "once the Adjudication hearing has taken place, case parties have received the Adjudicator's findings, and there has not been an appeal by either case party, then the Determination Order will be published on the website.

"However, if a case party appeals the Adjudicator’s findings, then a three-personal tribunal will rehear the case again with all the relevant evidence.

"The appeal period is ten days from when the Adjudicator’s findings are shared with case parties."
