Entrepreneur Declan Ganley has said that he is to continue legal action against the State, Denis O'Brien and Michael Lowry after US group Comcast told the High Court that it was withdrawing.

Mr Ganley was part of a consortium with Comcast which yesterday withdrew from the case, paid the costs of Mr Lowry and made a contribution to the costs of Mr O'Brien.

The case was originally taken by the Comcast consortium following the award of the second mobile phone licence to Mr O'Brien's Esat Digifone in 1996 while Michael Lowry was minister for communications.

The withdrawal by the US group was welcomed by both Mr O'Brien and Mr Lowry yesterday.

Mr Ganley said the case is now under his control.

The Comcast consortium originally included Mr Ganley, Comcast, RTÉ and Bord na Móna.
