Monaghan mechanic in €1.9m tax settlement with Revenue according to latest tax defaulters list

A county Monaghan based motor mechanic has reached a tax settlement with Revenue totalling €1.864m.

Eamonn Galligan, from Drumass, Inniskeen, was found to have under declared income tax following a Revenue investigation.

The settlement includes tax totalling €711,892, interest of €446, 615 and a further €705,582 in penalties.

By the end of September, none of the money had been paid, Revenue said.

The case was the largest settlement listed on the latest quarterly tax defaulters list covering the period from July to September.

The next biggest settlement involved a haulage firm, M.D.S Distribution Ltd, with an address at Road R, 1Q, Toughers Business Park, in Ladytown in Naas, Co Kildare.

It reached a settlement of €1.060m arising out of a Revenue investigation which identified an under declaration of VAT.

€660,830 of the total figure remained unpaid to Revenue at the end of September.

The settlement was made up of €399,331 in tax, €261,499 in interest and €399,331 in penalties.

Other large cases that feature on the list include a settlement totalling €809,423 by a clothes retailer, Wickham Properties Ltd, trading as Noel's, based at 5 Bedford Row in Limerick.

That related to an under-declaration of corporation tax, PAYE/PRSI/USC and VAT, which came to light following a Revenue investigation.

€463,423 of the total owed remained unpaid at the end of September.

Also on this quarter’s list is Pontvallen Ltd, a property holding company from Rusaguile House, Arbour Hill, in Dublin 7.

Its settlement came to €799,548 which was arose out of the under-declaration of Capital Gains Tax, which was found during a Revenue audit. All the money has been paid to Revenue.

While a landlord and PAYE employee, Kevin Boland, with an address at 174 Briar Walk in Portmarnock, was found to have under-declared relevant tax on share options in a level 3 investigation, leading to a settlement of €657,012, all of which has been paid.

Also listed among the settlements is a voice technology developer, Voysis Ltd, with an address at Hollyhill Industrial Estate in Cork.

It was found to have over-claimed Research and Development credits during a level 2 risk review, and settled for a total of €367,212.

Voysis was bought by Apple three years ago, but it is understood that the settlement relates to activity at a time prior to Apple’s involvement in the business.

In total, there are 24 settlement cases on the latest defaulters list with the total settlement amount reaching €9.6 million.

22 of the cases exceeded €100,000, with two cases exceeding €1m and eight cases where the money owed was not fully paid by then end of September, totalling €3.728m.

In relation to cases that involved a court determination, Frank Hynes, a company director from Bregorteen, Barntown in Co Wexford was found by the courts to owe a penalty of €440,930 arising out of the under-declaration of income tax totalling €473,761.

There were a further 63 cases where a fine or other court penalty was imposed for tax or duty offences, with €181,132 the total amount of court fines imposed.
