The UK Competition Commission has said it will be carrying on with the investigation as best they can pending the Competition Appeal Tribunal's judgment.
The commission has said it will extend the timetable to allow for the CAT hearing to come to a judgment on the matter of jurisdiction.
Ryanair has appealed to the Competition Appeal Tribunal against the Competition Commission's jurisdiction to investigate their minority shareholding in Aer Lingus, following their bid for the whole company and a likely European Commission investigation.
A case management conference was held yesterday and a hearing date has been set for July 27.
Ryanair owns 29.8% of Aer Lingus, acquired between 2006 and 2007, and recently made an all cash bid for the airline.
The investigation of the stake was referred by the UK OFT to the Competition Commission.
That investigation, originally held up because of the original EU investigation, has been suspended twice already.
The first time was because the OFT had insufficient information with which to proceed and the second time was due to a legal challenge by Ryanair, which was dismissed by the Court of Appeal in May and cleared the way to proceed.
