The Supreme Court has granted a stay on the winding up orders against two of property developer Liam Carroll's companies, Vantive and Morston, pending the determination of several appeals before the court.
The first appeal is by ACCBank against the decision in the High Court in August by Mr Justice John Cooke to grant Zoe leave to make its second application for examinership. That application was turned down by Mr Justice Frank Clarke earlier this month. The appeal will be heard on October 2.
Pending the outcome of that appeal, the Zoe group intends to appeal the refusal by Mr Justice Clarke to turn down its second application for examinership.
Chief Justice John Murray said any ensuing appeal would be heard as early as possible the following week. He added that the appeals were having a 'very heavy effect on important cases' before the court.
