The High Court has stopped Ryanair from proceeding with its challenge against the granting of planning permission for a second terminal at Dublin Airport.

The Dublin Airport Authority had asked the court to strike out Ryanair's challenge on the basis of an agreement the airline had previously made with the authority.

Mr Justice Frank Clarke ruled in favour of the DAA this morning and said the airline was bound by the previous agreement.

The DAA said it was a very positive development for all Dublin Airport's customers and stakeholders.

It said it removed the threat of any further unnecessary delay or obstruction to the delivery of the Airport's new terminal, which is due to open in April 2010 at a cost of €610m.

Earlier, a spokesperson for Ryanair said the airline was 'disappointed' with the decision.

However, this evening the airline confirmed that it will not be lodging an appeal to the Supreme Court.
