The High Court has refused to grant orders directing the wife of solicitor Michael Lynn to repay a €3.8m loan from Bank of Scotland, Ireland.
The bank was seeking judgment against Bríd Murphy for the repayment of the loan she took out with her husband, which the bank says was for the purchase of a house in Howth worth more than €5m.
However, Mr Justice Peter Kelly found that Ms Murphy had established an arguable case as to whether or not the bank was negligent and careless in granting the loan because it had not checked whether earlier undertakings given by her husband had been honoured.
The issue will now go to a full hearing next year.
