Bupa Ireland has been granted leave from the High Court to challenge the Health Insurance Authority's recent decision to recommend to the Minister for Health & Children the commencement of risk equalisation payments.
Bupa says it would lose up to around €34m if required to pay risk equalisation and would be forced out of the market, thereby reducing consumer choice.
The health insurer had threatened to pull out of the Irish market over proposals to make it compensate the VHI who take on older, unprofitable customers.
In a statement today, BUPA Ireland said it remains committed to the Irish market and its system of community rating.
