First conviction for company watchdog

The Office of the Director of Corporate Enforcement has secured its first conviction for fraudulent trading.

The conviction was against Sean Gannon, a director of Corran Building Services Ltd - which is in liquidation - and other companies. Mr Gannon was also convicted of failing to keep proper books of account and of failing to make annual returns to the Registrar of Companies.

Naas District Court imposed on Mr Gannon two concurrent sentences of six months, suspended for 12 months, in respect of the charges of fraudulent trading and failing to keep proper books.

ODCE chief Paul Appleby said the move confirmed its 'determination to prosecute the more serious abuses of company and director legal obligations and to use our investigative and remedial powers to sanction serious misconduct'.

He said it was also significant that the ODCE and the liquidator of the insolvent company collaborated together in achieving a mutually beneficial result.
