Brendan Dassey will not be released from prison tomorrow as an appeals court has blocked the Making a Murderer subject's release.
The 27-year-old, who has already been in prison for 10 years, is serving a life sentence for his role in the murder of Teresa Halbach in 2005, which was documented in the Netflix series Making a Murderer.
Dassey and his uncle Steven Avery were found guilty, in separate trials, for the crime, with Dassey convicted for first-degree intentional homicide, second-degree sexual assault and mutilation of a corpse.
In August of this year, federal judge William Duffin ruled the guilty verdict returned against Dassey by a trial jury in 2007 was based on a coerced confession he gave as a 16-year-old with a learning disability.
In his ruling he stated that Dassey could be released within 90 days unless prosecutors attempted to retry him, and on Tuesday Judge Duffin set a deadline for his release at 8pm on Friday.
When this ruling was made, Wisconsin Attorney General Brad Schimel said he intended to file an emergency motion seeking a stay of release order.
The Wisconsin appeals court said that they would be blocking his release as they feel Dassey is a "serious public safety issue" and he will remain in prison despite the conviction against him being overturned.
"The district courtʹs order releasing appellee Brendan Dassey is stayed pending resolution of this appeal," the order reads.
The state Justice Department is reportedly planning to file an emergency motion with the federal appeals court in Chicago.
