Judge says Porsche not at fault in Paul Walker crash

The widow of Roger Rodas, the driver in the November 2013 crash that took the life of both her husband and Furious 7 star Paul Walker, has lost her wrongful death lawsuit against the German car manufacturer. 

Rodas' wife, Kristine Rodas, filed a lawsuit against the company, alleging that the suspension system along with other design faults in the 2005 Porsche Carrera GT were responsible for the crash that killed her husband, who was driving the car, and passenger Walker.

On Monday (April 4) U.S. District Judge Philip S. Gutierrez said there was no evidence the Porsche's suspension failed before the crash, as Rodas' lawsuit claimed.

"Plaintiff has provided no competent evidence that Rodas' death occurred as a result of any wrongdoing on the part of defendant," Gutierrez wrote in papers obtained on Tuesday by the Daily News.

Walker's teenage daughter Meadow had filed a similar lawsuit against Porsche shortly after the tragic incident.

Porsche responded to the wrongful death lawsuit filed saying the crash was a result of "reckless driving and excessive speed".

“As we have said before, we are very sad whenever anyone is hurt in a Porsche vehicle, but we believe the authorities’ reports in this case clearly establish that this tragic crash resulted from reckless driving and excessive speed,” a representative for Porsche said in a statement given to Entertainment Weekly in September of last year.

Meadow Rain claimed that her father survived the impact of the crash, but the seat belt "snapped Walker’s torso back with thousands of pounds of force, thereby breaking his ribs and pelvis."

The lawsuit acquired by the US entertainment site further stated that the fire did not start until 1 minute 20 seconds after the crash, during which time Walker was still alive but he was unable to escape.

"Paul Walker breathed soot into his trachea while the Porsche Carrera GT burned," the lawsuit reads.

A message on Walker's Twitter page @RealPaulWalker on the day of the tragic incident read: "It's with a heavy heart that we must confirm Paul Walker passed away today in a tragic car accident..."

A statement on the actor's Facebook page read: "He was a passenger in a friend's car, in which both lost their lives. We appreciate your patience as we too are stunned and saddened beyond belief by this news.

"Thank you for keeping his family and friends in your prayers during this very difficult time. We will do our best to keep you apprised on where to send condolences."

A statement from Universal Pictures said: "All of us at Universal are heartbroken. Paul was truly one of the most beloved and respected members of our studio family for 14 years, and this loss is devastating to us, to everyone involved with the Fast and Furious films, and to countless fans."
