Halle Berry has reportedly pulled out of a film to prepare for a custody battle over her young daughter.

According to The Associated Press, a spokeswoman for the Oscar-winning actress said Berry backed out of a role in 'New Year’s Eve'.

Directed by 'Runaway Bride's Garry Marshall, the film stars Robert De Niro, Sarah Jessica Parker, Ashton Kutcher, Josh Duhamel, Lea Michele and Jessica Biel.

Filming was due to be begin in New York this week however publicist Meredith O'Sullivan said that “due to pending custody litigation involving her daughter” Berry had to bow out.

O’Sullivan did not say where or when the custody case between Berry and her ex-boyfriend Gabriel Aubry over two-year-old Nahla, would be heard.
