Having survived Sunday night's elimination, there is a new twist in the saga involving 'X Factor' contestant Katie Waissel.

The Sun alleges that she has appeared on a duet with US singer David Reed without the knowledge of the show's bosses.

The paper says that the track, 'Moving Mountains', was released last week on Reed's new album, 'The Private Life of David Reed', on Chamberlain Records, with Waissel appearing under her pseudonym, Lola Fontaine.

The Sun says that Simon Cowell's legal team spent thousands of pounds pulling Waissel out of a record deal and the 24-year-old was supposed to have severed all ties with Chamberlain Records.

'X Factor' contestants are not allowed to have a current recording contract, with the final 12 signing merchandise deals and show commitments.

A source told the paper: "Katie is supposed to have severed all ties with Chamberlain - but it's nonsense. She's still in contact with them and they're still releasing music by her.

"She might have hoped this would slip under the radar, but it's a bit foolish."

An 'X Factor' spokesman said: "We were unaware of this until today."

Waissel was placed in the bottom two with Aiden Grimshaw on Sunday night's show.

After the sing-off, Cowell and Cheryl Cole chose to save her, with Dannii Minogue and Louis Walsh choosing Grimshaw.

The deadlock meant the decision on who survived went to the results of the public vote, where Waissel had received more votes than Grimshaw.
