'X Factor' contestant Gamu Nhengu and her family have been granted the right to appeal the UK Border Agency's decision that they must leave the country and return to Zimbabwe.
The family's solicitor, Peter Farrell, said the case would be heard by the Immigration Court in Glasgow on 26 November.
The BBC reports that the family had been allowed to stay in the UK while Gamu's mother, Nokuthula Ngazana, was studying.
When the family's visa ran out the UK Border Agency turned down their application to stay because it said it did not meet all Home Office criteria.
