Britney Spears' lawyer has revealed why the singer has been ordered by a court to surrender custody of her two young children to her ex husband Kevin Federline.

Court papers did not reveal the reason behind the ruling but Spears' attorney Sorrell Trope said: "We weren't able to prove compliance with what the judge ordered".

According to People magazine the lawyer also said: "Specifically, the judge ordered that by 10 am (Monday) morning, both parties show valid California driving licences. I've been unable to produce evidence of that." Spears later applied for a driving licence.

Trope said that there "was a claim by Mr Federline's attorney that she had not complied with a previous order the court had made – before I came on board (as lawyer) – about having a random drug and alcohol test."

Her lawyer added: "There's no evidence that she actually failed a test."

The court ruling ordered that Federline take custody of two-year-old Sean Preston and one-year-old Jayden James from tomorrow, Wednesday, "until further order of the court".
