Lindsay Lohan has another court date. A judge has refused to dismiss portions of a lawsuit against the 21-year-old actress over an October 2005 accident in which her car collided with a van.

A Superior Court judge rejected a motion that argued the lawsuit lacked legal sufficiency, and set 7 April for the trial.

Lohan is being sued by van driver Raymundo Ortega, whose lawyer claims he was knocked out during the crash.

Mr Ortega claims the star was fleeing photographers and was drink-driving.

Local traffic police concluded at the time that Mr Ortega caused the accident by making an illegal U-turn. Lohan and a passenger sustained minor injuries.

"This case is about responsibility and she's not taking responsibility," Ortega’s lawyer said outside court.

Lohan's attorney, David J. Ozeran, said that there was no evidence that Lohan was intoxicated.

Last month, Lohan agreed to spend a day in jail and complete a drug treatment programme after pleading guilty or no contest to misdemeanor drunken driving and cocaine charges stemming from arrests earlier this year in Beverly Hills and Santa Monica.
