Prosecutors in Los Angeles were yesterday considering whether to file a formal charge against 65-year-old Hollywood actor Ryan O'Neal for assault with a deadly weapon.

He allegedly fired a gun during a brawl with his 42-year-old son, Griffin, at his home in Malibu last Saturday. He was freed on a $50,000 bond.

O'Neal was subsequently arrested on suspicion of assaulting his son with a deadly weapon and negligent discharge of a firearm.

The actor said he fired a warning shot into the air in self defence when his son attacked him with a poker.

He said his son lashed out at him during a fight but he ducked and the poker struck Griffin's pregnant girlfriend, Joanna Berry.

The dispute was allegedly over how Griffin treated his younger brother, Redmond, who is currently undergoing rehabilitation for a drug problem.
