A judge has thrown out George Harrison's bid to stop his former business manager and partner from declaring bankruptcy in the US.
Judge Barry Schermer has refused to accept a claim the musician was too ill to give a local deposition.
Harrison's lawyers have asked for a review of the ruling and a new judge.
Harrison has been trying to protect an $11m judgment he won in 1996 against Denis J O'Brien in a California state lawsuit that alleged mismanagement.
