The Supreme Court has set aside a judgement by the High Court that the National Maternity Hospital was responsible for the injuries suffered by a six-year-old boy at his birth.

The action taken by Paul Ciaran Fitzpatrick against Holles Street Hospital was settled on Wednesday after the hospital agreed to pay him €4.5m and to pay his legal costs of around €4m.

The original High Court decision found that if he had been delivered half an hour earlier, his injuries would not have happened.

The case has now been struck out with no admission of liability on the part of the hospital.
