RTÉ Archives Terms and Conditions

The terms and conditions that apply depend on the use of the material being requested. You can review the terms and conditions that apply to each of the different usage types below.

Broadcast/Publishing/Media Production/Commercial Production

General Terms and Conditions

  • These terms and conditions apply to the provision of archive material to the following groups, including, but not limited to: broadcasters, media production companies, publishers, advertising & marketing agencies, all corporate enterprises.
  • A minimum research charge will apply.
  • Customers must have paid by credit card or cheque or have completed a credit account with RTÉ Archives.
  • Where search criteria is vague or unclear, RTÉ Archives may request further information or advise that it is unable to complete the requested order.
  • Completion of the request form does not guarantee delivery of materials.
  • Supply of material from the RTÉ Archives is subject to availability, preservation status, copyright law, and to the discretion of RTÉ Archives at all times.
  • There is no obligation by RTÉ Archives to supply.
  • While every effort will be made to fulfil your request in the shortest period of time, RTÉ Archives accept no liability for any delay or disruption which may arise in respect of your request.

Licensing Information

  • Use of material supplied by RTÉ Archives for broadcast/media production incurs a licence fee. The cost of this licence fee depends on the rights/clearance requested, and in relation to RTÉ Television and Radio material, on the duration of the material used.
  • Payment generally must be made in advance of supply of broadcast/publication quality CDs, DVDs, audiocassettes or photographs containing archive material, except with regular business customers who may be set up with a credit account.
  • Material is provided on a strictly non-exclusive basis for use in one specified production or publication only.
  • Material must not be used in a manner that is detrimental to any person or body.
  • The user is responsible for clearing all music, appearance and performing rights and will indemnify RTÉ against any claims resulting from a failure to clear such rights. Written confirmation of clearance will be required from copyright holders in advance of supply of broadcast/publication quality material.
  • All library fees, duplicating costs, shipping costs and minimum royalty fees are payable in advance of supply of any copies.
  • The minimum non-refundable royalty fees for RTÉ Television or Radio archive material paid will be deducted from the final fee payable if that should be greater.
  • Royalty fees for usage of RTÉ Television or Radio archive material are charged according to length used on receipt of a usage declaration. Charges for use of photographic material are based on RTÉ Stills Library rate card. If no usage declaration is received within 30 days from date of supply, royalty fees are payable on total length or number of images supplied for the specified use.
  • Research by RTÉ staff incurs a €60.00 charge per hour or part thereof. The research fee applies even if the archive material is not used.
  • Any additional usage of RTÉ copyright material (in publicity campaigns, review articles etc.) needs to be cleared with RTÉ Archives first.
  • RTÉ Archives require a credit in publication or broadcast where RTÉ archive material is used.

Public Exhibitions

Terms and Conditions

  • You must agree to the Terms and Conditions for professional use of RTÉ archive material for public exhibitions in advance of submitting your request for archive material.
  • Payment generally must be made in advance of supply of broadcast/publication quality CDs, DVDs, audio-cassettes or photographs containing archive material, except with regular business customers who may be set up with a credit account.
  • Research services in excess of one hour will be charged in advance.
  • RTÉ Archives can only supply material where copyright is available.
  • You must agree to Licensing Terms in advance of supply of archive material.

Academic Research

Terms and Conditions

  • In general access will only be granted to students and academics from post-graduate level.
  • All student requests for access must include, where appropriate, a reference from the course director.
  • If deemed more appropriate, RTÉ Archives reserve the right to offer and undertake a mediated search and transfer of material.
  • Access to RTÉ Archives can only be granted where resources permit. The broadcasting needs of the organization will always take precedence.
  • All copies of material taken or received are subject to the signing of a copyright control agreement.
  • A charge for access and use of library services will be levied.

Private Use

Requesting Archives Material Terms and Conditions for Private Use

  • RTÉ archive material is made available on the understanding that it is for private use only.
  • You must agree to the Terms and Conditions for Private Use of archive material.
  • Payment must be made in advance of supply of CDs, DVDs, audiocassettes or photographs containing archive material.
  • Research services in excess of one hour will be charged in advance.
  • RTÉ Archives can only supply material where copyright is available.

Purchasing Archives Material Terms For Private Use

RTÉ will provide copies of archive material, on the strict understanding that it will not be further copied by you, will not be shown in public and will be used exclusively by yourself for the purposes of your own private viewing or listening.

Materials will be provided at the discretion of RTÉ with due regard to copyright law. Provision of any materials is subject to availability and preservation status of the materials.

You may not supply, sell or otherwise make available the use of the archive material provided to any third party, which would breach RTÉ's copyright as defined in the Copyright and Related Rights Act, 2000.

Materials are provided with the understanding that they are prohibited from use in the context of or in the course of any legal proceedings without the express written permission of RTÉ.
