Zeta-Jones & Douglas win Hello! case

Hollywood couple Michael Douglas and Catherine Zeta-Jones have won a partial victory in their legal battle against Hello! magazine.

A High Court judge in London this morning ruled that the magazine had breached the couple's rights to commercial confidentiality when it published unauthorised photographs of their wedding.

However he rejected the couple's claim that their privacy had also been invaded.

The couple welcomed the judgment, saying, "we deeply appreciate that the court has recognised the principle that every individual has theright to be protected from excessive and unwanted media intrusion."

The case took six weeks and cost more than £3m sterling in legal fees.

The celebrity couple had signed a deal with OK! magazine for the publication of their wedding photos, having turned down a higher offer from Hello!

Catherine Zeta Jones had told the court she'd been devastated and felt violated when paparazzi had gatecrashed their New York wedding.

This morning Mr Justice Lindsay ruled that Hello! had breached the star couple's rights of confidence because there had been an exclusive commercial contract with OK! magazine.

However in his ruling the judge also said the pair had no claim in law for an invasion of privacy.

The couple are claiming £500,000 in damages and OK! magazine wants £1.75m.

The judge has already ruled out awarding exemplary or aggravated damages but all sides will have to wait for a further hearing to determine exactly how much Hello! magazine will have to pay out.

The wedding took place at the Plaza Hotel in New York in November 2000.
