Arbitrator Michael Collins SC has ruled that the eircom League's original decision in relation to the Premier Division match between Bohemians and Shelbourne should stand.
The eircom League had ruled on 3 October that Bohs should be deducted three points for playing a player while he was suspended in their league game against Shels on 18 August.
Shelbourne appealed this decision and on 31 October the FAI Appeal Board ruled that Bohemians be deducted three points and ordered that the match be replayed in the interest of fair play.
Following that, the league requested the FAI to refer the matter to arbitration and Mr Collins was appointed as arbitrator.
Mr Collins ruled that Bohemian FC should be deducted three points, but rejected the decision to order a replay.
Shelbourne are level on 59 points with Derry City as the league enters its final phase of matches on Friday.
Ironically, the Tolka Park side host Bohemians as they try to capture the Premier Division title. Derry also face a tricky tie, as they entertain Cork City at The Brandywell in a dramatic climax to the season.
