A High Court action against the Garda Commissioner and the State by the husband of murder victim Sylvia Roche Kelly has been adjourned.

An application by the State to dismiss the case was listed for hearing today but has been adjourned until 30 June.

The action for wrongful death, which is being taken by her husband Lorcan Roche Kelly, alleges that her killer Jerry McGrath should have been in custody when he committed her murder in December 2007.

Mr Roche Kelly has claimed that his late wife's death was caused by neglect and default on the part of gardaí who dealt with McGrath, before and after her killing.
