The gardaí have responded to a claim that the closure of the Emergency Department at Letterkenny General Hospital is hampering garda investigations into serious road traffic accidents.
The Gardai cannot request blood or urine samples be taken from a suspect in a hospital in the north.
A source claimed to the Donegal News this is a serious problem as patients are transferred to Altnagelvin or Enniskillen while the emergency department in Letterkenny is closed following the recent flood.
A statement from the gardai said the closure of Letterkenny is of a temporary nature and it will be appreciated that "the preservation of life is of paramount importance and must take priority over criminal investigations.
“An Garda Síochána implement the legislation available to us within the jurisdiction."
Management at the hospital would not comment on the claim at a briefing on the current status of the recovery operation at the hospital.
Modular units were moved on site today and it is hoped that these along with mobile diagnostic units which had already arrived at the hospital, will allow for a temporary emergency department to be operational very soon.
