Abuse compensation case adjourned

The judicial review being sought by a man over a decision to reject his application for redress has heard closing arguments.

The judicial review being sought by a man over a decision by the Residential Institutions Redress Board to reject his application for redress has heard closing arguments from both sides.

Lawyers for the man said their client had contacted the RIRB in November 2005 and that the RIRB sent him an application form two weeks before the closing date.

They said the man did not know what to do with it and was not told about the closing date.

When the man visited the Irish Centre in Coventry in January 2006, he was helped to fill out the form by people at the centre.

The applicant claims he was seriously abused while a resident at an industrial school in the south of the country from 1947 to 1953.

Two years later he moved to England, where he has lived ever since.

However, Kevin Cross SC, for the redress board, said in oral hearings in October 2007, the man said he contacted the board in early 2006 and after the closing date for redress applications, which was on 15 December 2005.

He said there was ample sworn evidence for the board to come to the conclusion that it did.

The court heard that man was confused and that conflicting accounts were given while he was confused.

Justice Daniel O'Keefe adjourned the case and said he would give his verdict on Wednesday 24 June.
