Senior counsel for the Tribunal Denis McDonald said the Tribunal could not resist the order.
He said the Tribunal would not be appealing the High Court's decision.
Earlier this month, a three-judge divisional High Court ruled that Mr Ahern could not be questioned at the Tribunal about statements he made in the Dáil.
It ruled that documents relating to his banking expert were legally privileged and did not have to be handed over to the enquiry.
