The only person facing charges over the infection of women with Hepatitis C from contaminated blood products has lodged a Supreme Court appeal against the decision not to stop her trial on the grounds of delay.

Dr Cecily Cunningham, a former principal biochemist with the Blood Transfusion Service Board, was charged in July 2003 with unlawfully or maliciously causing infected anti-D to be taken by seven women causing them grievous bodily harm on dates in 1977, 1991 and 1992.

Dr Cunningham had argued in the High Court that a delay in bringing a prosecution against her had prejudiced her right to a fair trial.

But the court ruled the public had a right to have the matters brought to a conclusion.

The Dublin Circuit Criminal Court was today told that Dr Cunningham has lodged an appeal in the Supreme Court.
