High Court - Case to last four days

The High Court has been told that the Medical Council acted unfairly and unlawfully towards two consultant obstetricians in finding they were guilty of professional misconduct over reports exonerating the obstetric practice of Dr Micheal Neary at Our Lady of Lourdes Hospital in Drogheda.

Nicholas Butler, SC for Prof Walter Prendiville, said there was no evidence on which the council could have based such a finding.

In the proceedings before Mr Justice Peter Kelly, Prof Prendiville and Dr John Murphy are challenging the Medical Council's findings against them.

They are claiming unfair procedures, unlawfulness and irrationality in the council's findings and have also raised constitutional and human rights issues.

The case is expected to last for four days.
