Paralysed child treated unfairly - Ombudsman

The Ombudsman for Children has found that Fingal County Council treated a paralysed child unfairly by forcing his family to wait almost four years to be considered for a specially-adapted house.

The Ombudsman for Children has found that Fingal County Council treated a paralysed child unfairly by forcing his family to wait almost four years to be considered for a specially-adapted house.

The finding has prompted the local authority to begin adapting a new home to his needs. 

The council says it will also try to take all steps possible to ensure that such a situation does not arise again.

The 14-year-old whose mother asked Emily Logan to investigate this case is completely paralysed. He shares an unsuitable Fingal council house with his mother, who is his full-time carer.

When he was diagnosed with a progressive disabling disease almost seven years ago, his mother applied for a specially-adapted house and the council offered her a transfer.

But she rejected it, claiming the offered house had not been adapted for her son and citing medical advice that it would only meet his needs for a short while.
 
Over the following four years, the council received at least nine medical representations on the case but rebuffed them stating that the woman had refused a house specifically adapted for the boy in consultation with his occupational therapist.
 
But there is no documentary evidence of the OT's input and the Ombudsman says the offered house seems to have been initially adapted for another family.

The investigation found no evidence of any council review of the case for almost four years.

In a statement, Fingal's County Manager, David O'Connor accepted the report as fair, accurate and very helpful and vowed to take all steps possible to avoid a repetition of such a situation.
