The Morris Tribunal has heard that Frank McBrearty Junior never confessed to the murder of Donegal cattle dealer Richie Barron.
Mr McBrearty also told the tribunal that he had been 'tortured' for a number of hours while in garda custody.
He said that during his interrogation gardaí read a statement to him which they said had been made by his cousin Mark McConnell and which put him in the picture for hitting Mr Barron with an iron bar.
But he said he knew it was not his cousin's signature at the end of it because the surname was spelt wrong.
Mr McBrearty said Inspector John McGinley kept coming into the interview room and telling him to admit it and then he could go home to his family.
He also claimed that Inspector McGinley had been practicing his signature all day.
During his interviews he said he was severely abused and that at one point Detective Garda John Melody pulled a chair from under him and he fell and hit his head and neck against a filing cabinet.
He said the gardaí also told him that he was going to be shot by the IRA because he had informed on them.
Mr McBrearty told the tribunal he felt very distressed there this morning being asked for details about times.
He said it was impossible to be accurate but he said his story has never changed from the first day.
Mr McBrearty said he is not finished with the Garda Commissioner or the gardaí in question. 'When this is over I'll be going to a bigger forum', he said, and 'the lawyers here for the Minister for Justice can tell him that this is far from over'.
