Developer refused 75% of legal costs claim

A developer who failed to help the Planning and Payments Tribunal about a house built for Ray Burke has been refused 75% of his legal costs.

A developer who failed to help the Planning and Payments Tribunal about a house built for Ray Burke has been refused 75% of his legal costs.

Jack Foley, director of Oak Park developments who built Briargate for Mr Burke in the early 1970s, had sought €27,000 in costs for his appearance during the Brennan and McGowan module.

Tribunal Chairman Judge Alan Mahon said although no adverse findings had been made against Mr Foley he had not fully assisted the tribunal and should only get 25% of his costs.

RTÉ'S former Head of Network, John McGrath, was awarded 100% of his costs after the inquiry found he had not received a payment as alleged by Oliver Barry during the Century module.

He is seeking €97,000.
