Independent Newspapers fails in appeal to ECHR

Independent Newspapers has failed in its appeal to the European Court of Human Rights on issues arising from a libel action taken against the newspaper group by then Government minister Proinsias de Rossa in the 1990s.

Independent Newspapers has failed in its appeal to the European Court of Human Rights on issues arising from a libel action taken against the newspaper group by then Government minister Proinsias de Rossa in the 1990s.

The Independent had argued the that jury award of IR£300,000 was excessive and that there were no adequate safeguards in Ireland against such awards.

The action arose from an article in the Sunday Independent written by Eamonn Dunphy.

The court rejected the appeal by a 6 to 1 majority.
