The McBreartys say they are happy following a meeting with An Taoiseach, Bertie Ahern, as part of their campaign to get legal costs for the Morris Tribunal hearings.
They say they will be appealing a High Court decision that refused to award them costs for the inquiry into garda corruption in Co Donegal.
Frank McBrearty jnr said he appreciated Mr Ahern meeting with him and his father in Sligo following the cancellation of a meeting with Michael McDowell last month.
Next month the High Court will hear Frank McBrearty jnr's civil action against the gardaí.
He claims he was wrongfully arrested during the investigation into the death of cattle dealer Ritchie Barron.
